The Real Estate consists of the house located at 2700n Park Ave. Herrin IL 62948 (on parcel 02-18-253-005). Bidding will be placed on the property as a whole. Bidders are responsible for conducting their own inspections, investigations, inquiries and due diligence concerning the property. Real Estate Contract: The winning bidder will be required to enter into a Real Estate Sale Contract with the Seller. The Real Estate Sale Contract and other documents will be emailed to the winning bidder to print and accurately complete and sign without modifications and return via email, fax, certified mail or in person to Canning Auctions LLC 48HRS after the close of the auction (Wednesday May 12th) . Failure of the winning bidder to execute and return the completed contract according to these terms will render the winning bidder in default. Default by the winning bidder will result in that Bidder's liability to both the Seller and Canning Auctions LLC. Seller will have the right to declare this contractual agreement canceled and recover full damage for breach; OR elect to affirm this contractual agreement and enforce its specific performance; OR resell the property either publicly or privately AND the winning bidder (BUYER) shall be liable for payment of any deficiency realized from the second sale, plus all costs, including but not limited to the holding costs of the property, the expenses of both sales, and legal and incidental damages of both the Seller and Canning Auctions LLC. 5. The winning bidder will also be prohibited from bidding in any future auctions. 6. Closing for the Real Estate: The balance of the contract price will be due at closing. Possession will be given on the date of closing. Any personal property owned by the seller and left on the real estate will become the property and responsibility of the new buyer after the closing date. 7. You must be eighteen years old or older to register. In order to bid at this auction you will need to register and create a user name and password. Payment Terms
10% Buyers premium and 7.25% Sales Tax on all personal property items. If you are a winning bidder $1 will be charged to your credit card to pay for the retention of your credit card information. That charge will come off after the auction. BUT WILL BE ON YOUR INVOICE if you are a winning bidder. Following the conclusion of the auction the winning bidder's credit card will be billed for the total amount due. A PAID IN FULL receipt will be sent to the bidder upon verification of payment from credit card processor. Buyers who wish to pay for purchases by other methods i.e.: Cash or Check MUST contact Canning Auctions LLC prior to the close of the auction. Those payments are due before or at time of pickup. Buyer agrees that under no circumstances will he/she initiate a chargeback on his/her credit card. Declined credit/debit card transactions will be re-attempted twice. After the 2nd attempt items will be considered forfeited and may be re-sold at our discretion. Buyer's Premium: A buyer's premium of 10% will be charged on all personal property. The winning bidder is required to make an earnest money down payment in the amount of $5000. The deposit must be paid by 4:00 p.m. the day following the close of the auction. Pick up for successful bidders will be on Tuesday May 11th, Wednesday May 12th & Friday May 14th at 2700 N Park AVE Herrin IL 62948. Payment of cash, check, or charge are acceptable forms of payment. If items are not paid for and picked up by the close of business Friday May 14th Canning Auctions reserves the right to charge the card on file. Shipping is not available unless pre-arranged with Canning Auctions LLC prior to bidding. All items must be picked up on-site.
